TAKE NOTICE that the named Plaintiff has filed a Complaint in Action to Quiet Title averring the following:
(1) The property in question is all that certain piece or parcel of land situated in the Sadsbury Township, Crawford County, Pennsylvania, bounded and described as follows, to wit:
All that certain piece, parcel, or tract of land situate in Sadsbury Township, Crawford County, Pennsylvania, bounded and described as follows:
Beginning at a point on the south line of Sunnyside Avenue, said point being at the northwest corner of Lot 43 of the Walster Plan of Lots recorded in Crawford County Deed Book 231, Page 595, said plan also being at the northeast corner of the land herein described; thence North 85 degrees 05 minutes West along the south line of Sunnyside Avenue, a distance of 50 feet, said point being at the northeast corner of Lot No. 45 of said Walster Plan of Lots, and being at the northwest corner of land herein described; thence South 05 degrees 06 minutes West along the easterly line of said Lot No. 45 a distance of 106 feet to a point, said point being at the southwest corner of the land herein described, and being at the southeast corner of Lot No. 45; thence South 85 degrees, 05 minutes East along the northerly line of Lot No. 29 a distance of 50 feet to a point, said point being the southwest comer of Lot No. 43, and being at the southeast corner of the land herein described; continuing North 05 degrees 06 minutes East along the West line of Lot No. 43 a distance of 106 feet to a point, being the point and place of beginning.
Being all of Lot No. 44 in the Walster Plan of Lots as laid out and recorded in Crawford County Deed Book 231, Page 595, and being the same property that is the subject of an Affidavit of Adverse Possession filed by the Alan E. Heil of Light Gate and recorded immediately prior hereto.
Hereinafter Known as (the “Lot 44 Property”)
(2) That any and all interest of All Heirs, Representatives, Successors, and Assignees of William Walster and J.T. Echnoz has in the Lot 44 Property is terminated, void, and of no legal affect;
(3) That the Plaintiff is the sole and exclusive, fee simple owner of Lot 44 Property and not subject to any claim or interest by the Defendants or any successor or assigns;
(4) Plaintiff avers that, after considerable due diligence, the present whereabouts or existence of the above-named All Heirs, Representatives, Successors, and Assigns of the William Walster and J.T. Echnoz, is unknown to it; and
(5) Plaintiff has requested the Court to enter a decree that title to the Lot 44 Property is vested in the Plaintiff, solely, free from any claim of All Heirs, Representatives, Successors, and Assigns of the William Walster and J.T. Echnoz from asserting any interest to the Lot 44 Property or from impeaching, denying or in any way attacking Plaintiffs exclusive title to the Lot 44 Property.
TAKE NOTICE THAT THE COURT HAS ORDERED THAT THE AFOREMENTIONED COMPLAINT BE SERVED BY PUBLICATION.
