Anthony James Withers hereby is notified that Samantha Dawn Withers has commenced an action for declaratory judgement to determine marital status or in the alternative an action for annulment on March 31, 2021 in the Court of Common Pleas of Crawford County, Pennsylvania, No. F D 2021-103S. An amended complaint, to include the Notice To Defend and Claim Rights, was filed on May 21, 2021 and reinstated on August 11, 2021. The grounds for declaratory judgement or in the alternative, annulment, are the marriage is void pursuant to 23 Pa.C.S.A. 3304 Section (a}(1) as Anthony James Withers was already married to another person at the time he married Samantha Dawn Withers. Anthony James Withers, as defendant, further is advised that Samantha Dawn Withers alleges she and Anthony James Withers were married on June 15, 2019 in Titusville, Pennsylvania. Samantha Dawn Withers further avers that she currently is a resident of Duncan, Oklahoma, but at the time of filing she was a resident of Oil City, Pennsylvania and that the exact whereabouts of Anthony James Withers are unknown.
